Terms and Conditions for ClubTicket

ClubTicket is operated by Club Ticket Promotions Ltd, a company registered in England and Wales under company number 13467805, whose registered office is at 77 East Road, London, England, N1 6AH ("ClubTicket", "we", "us").

By joining ClubTicket Unlimited or purchasing a ticket, you agree to be bound by the following Terms and Conditions ("Terms"). Please read them carefully.

1. ClubTicket Unlimited Membership

1.1. Service Description: ClubTicket Unlimited is a paid membership that provides access to a changing selection of eligible tickets, events, offers, experiences, early releases and other member benefits. It renews automatically each month until cancelled. Benefits and participating events may change, and all tickets remain subject to availability and their individual conditions. Membership does not guarantee access to every event or admission to a venue.

1.2. Membership Price: The current Membership price, billing frequency and any discount, trial or introductory offer will be shown before you join. Unless an offer states otherwise, the Membership renews monthly and payments are taken in pounds sterling (GBP).

1.3. Pausing your Membership: Where the option is shown in your account, you may pause your Membership for up to two weeks in any six-month period. You will not be charged while the Membership is paused and your next Billing Date will be adjusted accordingly. While paused, you cannot claim or use member tickets or benefits, and any claimed tickets for dates falling within the pause period will be cancelled. Your account will show the pause end date and next payment date.

2. Ticket Purchase and Booking

2.1. ClubTicket's Role: ClubTicket is a ticketing and distribution platform. It sells tickets on behalf of venues and event organisers and acts only as their disclosed ticketing agent. ClubTicket does not organise, host, stage or operate any event. Events are listed under the event or brand name and the venue. The contract for the event itself is between you and the venue or event organiser, who is responsible for the event. The venue's own terms and conditions and door policy, and any event-specific conditions shown before purchase, also apply.

2.2. Booking Confirmation: A booking is confirmed once payment has been accepted and a unique booking reference issued. Confirmed bookings receive a unique ClubTicket ticket for each ticket purchased. By purchasing a ticket, you acknowledge that you have read, understood and accepted these Terms.

2.3. Pricing and Availability: ClubTicket and the relevant organiser may increase or decrease advertised prices before purchase. All bookings are subject to availability, and ClubTicket may decline a booking where reasonably necessary, including to prevent fraud or misuse.

2.4. Contract and Jurisdiction: The contract, including all matters arising from it, is governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the courts of England and Wales. No employee or representative of ClubTicket may vary these Terms or promise a discount or refund unless authorised to do so.

2.5. Booking Fees: Where a booking fee applies, it is shown per ticket together with the ticket price and total payable before you complete the purchase.

2.6. Your Tickets: Your tickets are stored in your ClubTicket account. Each ticket has its own QR code and admits one person once. A ticket that has already been scanned will not be accepted again, so keep it secure. At the door you can show the ticket in your account, where the QR code refreshes on screen, or the ticket PDF sent to the email address used for the booking.

2.7. Ticket Transfers and Resale: Where enabled for an event, you may send a ticket to another person by email from your account. Once claimed, it belongs to the recipient and is no longer usable in your account. Tickets must not be resold for profit, offered through an unauthorised resale channel or duplicated.

3. Membership Payments

3.1. Billing Cycle: By joining, you authorise ClubTicket to charge the Membership fee to your selected payment method every month on the date of your initial payment ("Billing Date").

3.2. Automatic Renewal: Your Membership will automatically renew at the end of each monthly billing cycle unless you cancel it as set out in Section 4.

3.3. Payment Methods: You must maintain a valid payment method on your account. If your payment fails, we may attempt to process the payment again or suspend your access to the service until payment is successfully processed.

3.4. Price Changes: We may change the Membership fee by giving you at least 30 days' notice. The new price will not be charged before the first renewal after that notice period. If you do not agree to the new price, you may cancel your Membership before it takes effect as set out in Section 4.

3.5. Payment Processing: Payments for tickets and Memberships are processed securely by Stripe. You can pay by debit or credit card, and by Apple Pay or Google Pay where your device and browser support them. ClubTicket does not see or store your full card number.

3.6. Currency: Prices are set in pounds sterling (GBP). If you pay with a card from another country, the payment page may offer to show and charge the amount in your local currency; the converted amount is shown before you pay.

4. Refunds and Cancellations

4.1. Membership Cancellation: You may cancel your Membership at any time from the Unlimited page in your account. If you cancel, your Membership will remain active until the end of your current billing cycle, and you will not receive a refund for any unused portion of the Membership fee, except where the law requires otherwise.

4.2. Customer Cancellation: Unless the event listing or organiser's refund policy expressly provides otherwise, tickets are non-refundable if you change your mind, cannot attend or fail to attend. This does not affect the rights set out in Section 5 where an event is cancelled, postponed or materially changed.

5. Event Modifications and Cancellations

5.1. Postponed, Rescheduled or Materially Changed Events: The relevant venue or event organiser decides whether an event is postponed, rescheduled, materially changed or treated as cancelled. If an event is postponed or rescheduled, your ticket will normally remain valid for the new date. You will also be given an opportunity to apply for a refund within the period communicated to you. If the organiser treats the event as cancelled, Section 5.2 applies. Minor changes, including changes to supporting performers or event timings, do not automatically create a right to a refund.

5.2. Event Cancellation: If an event is cancelled, ClubTicket will contact affected ticket holders as soon as reasonably possible and provide a full refund of the ticket price and any ClubTicket booking fee paid for that ticket, returned to the original payment method. The refund is made within 14 days of the event being cancelled. This does not affect your statutory rights.

5.3. ClubTicket Unlimited Tickets: An Unlimited ticket has no separate cash purchase price. If an event or member benefit is cancelled, postponed, rescheduled, changed or becomes unavailable, the Unlimited ticket will be cancelled or will remain valid for the rearranged event, as applicable. No cash refund is payable for the Unlimited ticket and the cancellation or change of one event does not entitle you to a refund or credit of your Membership fee. ClubTicket may offer a replacement benefit at its discretion. This does not affect any statutory rights that apply to the Membership itself.

6. Participant Responsibilities and Risks

6.1. Participant Liability: Participants, together with their personal property, are at all times solely at their own risk. ClubTicket accepts no liability for any personal injury, damage, or loss, except for death or personal injury caused by its negligence, fraud, or any other liability that cannot lawfully be excluded. Participants are responsible for arranging their own insurance.

6.2. Fitness to Participate: All participants are expected to satisfy themselves prior to booking that they are fit and able to complete the event. Participants should be aware of their physical and mental limitations before attending an event. Participants with medical conditions or who are pregnant are strongly advised not to participate and must inform ClubTicket of their condition prior to the event. This does not limit ClubTicket's liability for death or personal injury caused by its negligence.

6.3. Alcohol and Intoxication: Where alcohol is available, you must drink responsibly and follow the venue's and organiser's rules. The venue or organiser may refuse alcohol service, refuse entry or remove anyone who is intoxicated or behaving unsafely, without a refund. ClubTicket is not responsible for decisions made by the venue or organiser or for harm caused by a participant's own excessive drinking, except for liability that cannot lawfully be excluded.

6.4. Age Requirements: You must be at least 18 to create a ClubTicket account, buy tickets or join ClubTicket Unlimited. An adult may buy a ticket for a younger attendee only where the event expressly allows that age group. The age and identification rules shown on the event listing or imposed by the venue or organiser always apply.

7. Conduct and Behaviour

7.1. Behaviour Standards: Participants agree to accept the authority and reasonable decisions of the relevant venue, event organiser and their staff. They may refuse entry or remove participants who are intoxicated, disorderly, aggressive, abusive, anti-social, unable to provide valid identification or in breach of the event's entry conditions. In such cases, no refund will be provided and the participant is responsible for any additional costs incurred.

7.2. Indemnification: The participant agrees to indemnify ClubTicket (its employees, directors, suppliers, agents, distributors, representatives, etc.) against any third-party claims as a result of the participant's behaviour and actions.

8. Account Management

8.1. Account Responsibility: You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.

8.2. Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or if we are unable to process your payment.

8.3. Messages and Marketing: Service emails about your orders, tickets, Membership and account are part of the service. Where permitted by law, ClubTicket and the named venue, organiser or promoter may send you marketing about similar tickets, events, offers and memberships unless you opt out. At checkout, you can tick the marketing opt-out box if you do not want these messages. You can also opt out later in your account or by using the unsubscribe link in any marketing email. Our Privacy Policy explains this in full.

9. Intellectual Property

9.1. Ownership: All content, trademarks, and intellectual property associated with ClubTicket are owned by us or our licensors and are protected by applicable laws.

9.2. Limited Licence: Your Membership or ticket purchase grants you a limited, non-exclusive, non-transferable licence to access the services for personal, non-commercial use.

10. Limitation of Liability

10.1. Disclaimer: To the fullest extent permitted by law, ClubTicket Unlimited and ClubTicket disclaim all warranties, express or implied, in connection with the service and your use thereof.

10.2. Limitation: In no event shall ClubTicket Unlimited, ClubTicket, their affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use or inability to use the service.

10.3. Your Statutory Rights: Nothing in these Terms affects your statutory rights as a consumer or excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

11. Governing Law

11.1. Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of laws principles.

11.2. Courts: The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

12. Changes to Terms

12.1. Amendments: We may update these Terms from time to time. If we make significant changes, we will notify you via email or through your account.

12.2. Acceptance of Changes: Your continued use of the Membership or attendance at an event after any changes to these Terms constitutes your acceptance of the new Terms.

13. Force Majeure

13.1. Events Beyond Reasonable Control: ClubTicket, its partner venues and event organisers are not liable for any failure or delay in holding an event, or for any change to or cancellation of an event, caused by circumstances beyond their reasonable control. These include, for example, extreme weather, fire, flood, epidemic or pandemic, restrictions or orders of government or public authorities, strikes, failure of transport or utilities, terrorism and civil unrest.

13.2. Organiser Decision and Funds: A Force Majeure event does not by itself mean that an event is cancelled or that an automatic refund is due. The venue or organiser may decide to continue, postpone, reschedule, relocate, materially change or cancel the event. While that decision is being made, ClubTicket may hold ticket funds and temporarily suspend payouts to the venue or organiser for a reasonable period. If the event is cancelled, refunds are made within 14 days of the cancellation, as set out in Section 5.2.

13.3. Outcome: If the event is postponed, rescheduled or materially changed, Section 5.1 applies. If it is cancelled, Section 5.2 applies. Unlimited tickets are handled under Section 5.3. Nothing in this Section excludes or limits a customer's statutory rights.

By joining ClubTicket Unlimited or purchasing a ClubTicket ticket you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
